IMPLEMENTATION OF THE PRINCIPLE OF CAVEAT VENDITOR IN PROTECTING CONSUMER RIGHTS (A STUDY OF DRUG SELLING WITHOUT MARKETING PERMISSION FROM BADAN PENGAWAS OBAT DAN MAKANAN (BPOM) INDEPENDENTLY AT DEPOK CITY). Faculty of Law of Sebelas Maret University, Surakarta. The purpose of this study was to examine how the implementation of the principle of caveat venditor in protecting consumer rights on the practice of drugs selling independently without marketing permission from Badan Pengawas Obat dan Makanan (BPOM) at Depok City. This research is a normative law prescriptive, used the act approach and case approach by assessing the library materials or secondary data that examine how the implementation of the principle of caveat venditor (prudential business actors) in an effort to protect consumer rights under the Act No. 8 of 1999 on Consumer Protection related to the practice of drugs selling without a marketing permission from Badan pengawas Obat dan Makanan (BPOM) at Depok City. This research using primary, secondary, and tertiary legal materials. The method of collection of legal materials is literature study. Legal materials that have been collected and analyzed with the approach by the statute and case approaches. Collection techniques used sources of legal materials is the study of literature and internet references. Analysis of the research is deductive syllogism with the collection of research sources to interpret the relevant norms, then the source of the study was processed and analyzed to answer the problem under study. Based on research results can be concluded that the concept of the principle of caveat venditor in consumer protection efforts in accordance to the Act No. 8 of 1999 on Consumer Protection that is contained in Article 4 on the gift of rights to consumers and on Article 7 concerning the imposition of obligations to businesses. Then the implementation of the principle of caveat venditor to practice medicine without a marketing permission by Badan Pengawas Obat dan Makanan (BPOM) is to implement all relevant provisions in protecting the rights of consumers who consume the drug vii perpustakaan.uns.ac.id digilib.uns.ac.id commit to user ix product as listed in Article 4 and Article 7 of the Act No. 8 of 1999 on the Consumer Protection. This is done to prevent and reduce the negative excesses that can be suffered by consumers due to the illegal drug circulation.
