This research aims to obtain data and information more clearly and completely about the policy of Public Business Credit (KUR) issuance in Surakarta Ngemplak Unit of PT. Bank Rakyat Indonesia concerning the process of Public Business Credit (KUR) issuance without guarantee bringing about the creditor’s and debtor’s right and obligation as well as the problems occurring from the agreement of Public Business Credit without guarantee, and the measures taken by Surakarta Ngemplak Unit of PT. Bank Rakyat Indonesia in coping with them. This study is a descriptive research and viewed from the objective, it belongs to an empirical or nondoctrinal research. The research was taken place in Surakarta Ngemplak Unit of PT. Bank Rakyat Indonesia. The data types employed were primary and secondary data. Techniques of collecting data used were interview and literary study including books, law and ordinances, documents, and etc. Technique of analyzing data used was a qualitative data analysis with interactive model. Based on the field research, it can be seen that the process of Public Business Credit (KUR) issuance without guarantee can be conducted in several stages: credit application, credit review and analysis, credit decision giving, credit agreement and credit clearing. Before the credit agreement established, the prospect debtor should meet the predefined conditions from Surakarta Ngemplak Unit of PT. Bank Rakyat Indonesia. The right and obligation occurring between both parties are not balanced because the agreement containing clauses is determined first by the bank alone. The problems occurring from the agreement of KUR issuance without guarantee in Surakarta Ngemplak Unit of PT. Bank Rakyat Indonesia include four fundamental things: the problematic credit, fund clearing process delay and credit documentation and administration regulation as well as limited human resource (HR) quality and quantity. The Surakarta Ngemplak Unit of PT. Bank Rakyat Indonesia attempts to cope with such problems by rescheduling and enacting the guarantee imposition. The improvement of HR is done by building program in the term of KUR expert training in order to have the banking managerial and technical skills. In the attempt of improving the HR quantity, the Surakarta Ngemplak Unit of PT. Bank Rakyat Indonesia should increase the number of personnel handling the KUR so that there is no delay of fund clearing process and KUR distribution can run well. From the substance aspect, the problem constitutes the dysharmonization about the guarantee imposition between the Act No.10 of 1998 about the banking and the President Instruction No.5 of 2008 about the Focus of Economic Program During 20082009 and the third problem is about the limited knowledge the debtor has.
