Abstract

ABSTRACT Tiara Prihatningsih, S.H., S351508038, Compensation Payment Implementation for Land Ownership Holder on Procurement Land of Tollroad Construction of Solo-Mantingan I in Desa Sawahan, Kecamatan, Ngemplak, Kabupaten Boyolali, 2018, Notary Program of Law Faculty Universitas Sebelas Maret. This research aims to find out and answer problem statement concerning Implementation of Compensation Payment for Land Ownership Holder on Tollroad Construction of Solo-Mantingan I in Desa Sawahan, Kecamatan Ngemplak, Kabupaten Boyolali, in deliberation process as provided in Article 37 Act No. 2 of 2012 concerning Procurement Land of Development For Public Interest and aspect of justice in giving Compensation Payment for Land Ownership Holder on Tollroad Construction of Solo-Mantingan I in Desa Sawahan, Kecamatan Ngemplak, Kabupaten Boyolali. This research uses empirical legal research which has nature analytical descriptive. This research also uses statute approach and conceptual approach. The research is conducted in Boyolali. Type of data used is primary data consisting of primary, secondary, and tertiary legal material. Techniques of collecting legal material uses interview and literature review. Technique of analysis data is conducted by qualitative data analysis using analytical descriptive method. Based on the research finding and discussion, it is concluded that compensation payment for land owneship holder of tollroad Construction of Solo-Mantingan I in Desa Sawahan, Kecamatan Ngemplak, Kabupaten Boyolali, is given without going through any deliberations, because its process takes a long time. Meanwhile, the government is asked to finish the project of tollroad Solo-Mantingan I immediately by Central Government. The value of compensation for land acquisition of tollroad Solo-Mantingan I was decided by Kantor Jasa penilai Publik (KJJP) of Central Government, the price is absolute and there is no bargain process. There is no aspect of justice in processing Compensation payment for land ownership holder of Construction of Solo-Mantingan I in Desa Sawahan, Kecamatan, Ngemplak, Kabupaten Boyolali, because there are differences in the compensation value, compensation payment value was decided by KJJP of Central Government which the land was valued on per-sector, and there is no deliberation held becomes a reason for citizens to file a lawsuit to the District Court.
