    Abstract

    The purpose of writing this article isto know and anlyze about the authentication power of an authentic deed made by a notary after being declared bankrupt by the commercial court, and whether a notary who is a pibilc official of the state may be declared bankrupt. Research methods used to achieve the objectives of this legal research using normative jurudical approach method. The data analysis technique used in this research is using descriptive analysis method approach which then cantinued with method of interpretation analysis. The bankruptcy decision of the commercial court may be granted to a notary who is an authoritative public official of the authentic deed, because the notary is a position attached to the legal subject of the person. A notary can not necessarily be declared bankrupt by the court, but must be seen from the causes of bankruptcy experienced, whether it meets the requirements of bankruptcy laws or under the circumstances actually experienced by a notary. The granting of a bankruptcy verdict to a notary who has met the requirements in article 2 of law number 37 of 2004 concering bankruptcy ad postponement of debt obligation causes the deed made by or before the notary to only have the power as the writing under the hand, as referred to in article 1869 of the civil code law. But if the notary’s bankruptcy isbased on the actual circumstances, the notarial deed still has the power as an authentic deed.
