    Abstract

    The objective of this legal research is study the problem dealing with the implementation of diversion in solving criminal act of theft by children and the obstacles of the implementation of diversion in Police Resort of Klaten. This research is descriptive empirical law research with qualitative approach. This study uses primary and secondary data types. Mechanical collection of law data that are used by interview, observation and literature study. Data analysis techniques used in this legal research is qualitative. The results of this study indicate that the implementation of restorative justice can be fulfilled through diversion efforts to resolve the criminal act of theft by children in Police Resort of Klaten and this matter was in line with the Act Number 11 of 2012 on Criminal Justice System of Children which is reflected the restorative justice concept and the diversion’s objective that has been settled upon article 6 of Act Number 11 of 2012 on Criminal Justice System of Children which accomplish reconcilement between the victim and the children, solve the criminal act by children case outside of the court, prevent the children from the freedom’s deprivation, encourage the citizens to participate and enforce the children responsibility. Meanwhile, the obstacles of the implementation of diversion is the internal obstacle in the form of the lack of human resources and the less proper facilities in dealing the case, meanwhile the external obstacle is the legal protection unavailability that regulate diversion and restorative justice specifically in our country.
