    Abstract

    ABSTRACT Nita Erlytawati. 2017. E0013301. COMPARATIVE STUDY OF RAPE REGULATION IN INDONESIAN CRIMINAL CODE AND SINGAPORE PENAL CODE (CHAPTER 224). Legal Writing. Law Faculty of Sebelas Maret University Surakarta. This research aims to know how rape is regulated in Indonesia and Singapore and to know the similarities and the differences and recommendations on the regulation of criminal acts of rape in Indonesian Penal Code in the future. This research is considered as a normative that uses statute approach and comparative approach. In this research, the legal materials which are used are primary legal materials and secondary legal materials, the primary legal materials are the Indonesian Criminal Code, The Law Number 23 in 2004 on Elimination of Domestic Violence, The Law Number 35 in 2014 about change in The Law Number 23 in 2002 on Child Protection, Singapore Penal Code (Chapter 224), Women’s Charter (Chapter 353) and the secondary legal materials are books, journals, reports, and dictionaries which relate to rape. Library research is used as a collection of legal material technique while deductive method is used for analyzes the legal material. According to the result of this research, there are some similarities and differences in rape regulation in Indonesian Penal Code and Singapore Penal Code (Chapter 224), such as in the case of basic philosophical arrangements rooted in the values of human rights, the definition and the perpetrators of rape, while the difference in the legal system adopted that influences its regulation. Then from the similarities and differences are found the shortcomings and advantages of each country that can be used as a reference by the Indonesian Criminal Code in regulating of criminal act of rape in the future.
