    Abstract

    ABSTRACT Agus Suprijanto, 2017, Public Participatory Model in Local Regulation of Education Formating Process in Central Java. Promotor : Prof. Dr. Jamal Wiwoho, SH.,M.Hum.; Co-Promotor : Dr. Djoko Wahju Winarno,SH.,MS. Dissertation. Surakarta : Docotoral Program of Law Science, Postgraduate Program of Sebelas Maret University. This study aims to analyze and describe the implementation of public participation in the formation process of educational legislation of Districts / Cities in Central Java, to identify and analyze the problems of the public participation, and to analyze and describe the solution of the problems and to develop the models of public participation which can be applied. The study used juridical sociological or socio-legal research, with research data consist of primary and secondary data (primary and secondary legal materials). The research conducted in four research areas, namely Grobogan, Batang, Pekalongan, Banjarnegara,Rembang District,Semarang,Magelang and Surakarta Cities. The primary data done by interview to the stakeholders associated with the process of establishing educational regulations, while secondary data performed by archival documentation. Qualitative analysis used as the analysis technique. This study showed that the level of public participation in the research area are quite low at every stage. The problems related with the public participation merely caused by the limitation of the access and capability of the public or their representatives to be able to contributed at every stage of the process. Researcher propose the optimalization of the public participation at every stages of the process, from the early stages of discussion of the draft to the evaluation stages. The solution by the researcher emphasized on the public participation model that formed based on generelization of the public participation problem’s characteristics. Besides requiring the proponent to engage the active participation of communities at every stage of the establishment of regulations, this model also emphasizes the formatting process of academic papers involving the third party that expertise educational materials competencies. The model also emphasized the evaluation rights of the community so that the public can provide an assessment and called for the process to be halted temporarily to be repaired, with the hope that the matter being discussed or the participation of community participation improved to be better. Researcher recomendating the revition of the regulation that insisted the regional regulations’ initiator to involve the public particiation at every stages and also insisted the initiator of the regional regulations to harmonized the materials of the regional regulations in accordance with the latest regulations. keywords : Public participatory, formatting process, regional regulations of education
