    Abstract

    Dila Eka Juli Prasetya, S311508006, 2017, Legal Politics of Authority Relations between Regency/City Governments and Village Governments on Villages’ Financial Management. Thesis: The Graduate Program in Law Science, Sebelas Maret University, Surakarta. The objective of this research is to analyze the legal politics of authority relations between the regency/city governments and the village governments. It also studies an ideal construction of the legal politics of authority relations between the regency/city governments and the village governments on the villages’ financial management. This research used the prescriptive normative legal research. It employed the statute, historical, and conceptual approaches. The data of research consisted of primary and secondary legal materials. The results of research are as follows: Firstly, the legal politics of authority relations between the regency/city governments and the village governments on the villages’ finanacial management following the enactment of Law Number: 6 of 2014 regarding Villages show that the village governments have a very vital and strategic position. Such a position at the same time raises big burdens to the villages to manage administrative matters on the villages’ financial management. Secondly, the ideal construction of the legal politics of authority relations between the regency/city governments and the village governments is by delegating the village governments’ authorities related to administrative matters to the governments at the sub-district levels so that they merely work on the preparations of income and expenditure budgets and reports on the budget realizations simply, but, their details and administrations technically are completed by the governments at the sub-district levels. The implication of the on-going legal politics is that it threatens the existence of villages’ autonomy because the administrative matters on the villages’ financial management will restrict the administrations of the village governments. Thus, the delegation of authority on the administrative matters to the upper governments (sub-district governments) is required. In addition, such a delegation is a form of role optimization of the sub-district governments, which is not merely as an alter ego of the regents or mayors.
