    Ashinta Sekar Bidari. S320811003. The Legal Politics in the Establishment of the Financial Service Authority as a Banking Sector-Supervising Institution in Indonesia. Thesis: The Graduate Program in Law Science, Sebelas Maret University, Surakarta 2013. The objective of this research is to study the legal politics in the establishment of the Financial Service Authority as an institution to supervise the banking affairs in Indonesia and the constraints encountered by the Financial Service Authority in carrying out its role and function as a banking sector-supervising institution in the future. This research used the normative legal research with the descriptive and evaluative design. It applied legislative, comparative, and historical approaches. The sources of the secondary data of the research were primary law material and secondary law material. The data of the research were gathered through library research. The results of the study based on the Critical Legal Studies show that the establishment of the Financial Service Authority has ended the “political clash” between the Indonesian Government and the Bank of Indonesia. The Financial Service Authority has begun since the government under the reign of the former President BJ Habibie proposed the amendment of Law of the Bank of Indonesia Number: 13 of 1968 with Law Number: 23 of 1999, namely: Article 34 which mandates that the task to supervise the banks in Indonesia would be done by an independent supervising institution of financial service sector. This is due to the financial crisis in 1997/1998. In the formation of Financial Service Authority, there is a tendency of political interest motives, which makes it require ten years to emerge. The legal political should prioritize the public interest and prosperity because the legal politics is a strategy or a measure taken to reach the goals of the state or the government. However, the legal politics in the formation of the Financial Service Authority has not put its priority on the public prosperity as it is still driven by external interests which are against the public interests. The existence of the Financial Service Authority has been inspired by British and South Korea which fail to impose the same authority and Japan which successfully implements the similar authority. Based on the comparison made among the three countries, a formulation can be made on the constraints that will be encountered by the Financial Service Authority in Indonesia such as the independency constraint, the coordination constraint, the constraint of integrating the structure organization of staffs, and the constraint of harmonizing the prevailing regulations. The establishment of the Financial Service Authority shall be made as a momentum to prove that it is able to substitute the role of the Bank of Indonesia as an institution to supervise the banking sector and to materialize the supervision better. The legal politics shall not be used as a political game. Yet, it shall aim at prioritizing the public interest for the sake of economic stability public prosperity. The legal politics is expected to be more transparent, accountable, and sociable to the public. In the future, therefore, the government shall be able to materialize the legal politics which prioritizes the economic stability and the public prosperity so that the prevailing system does not easily change. Penelitian ini mengkaji politik hukum pembentukan Otoritas Jasa Keuangan (OJK) sebagai lembaga pengawas perbankan dan kendala OJK dalam menjalankan peran dan fungsi sebagai lembaga pengawas perbankan ke depannya. Penelitian ini adalah penelitian hukum normatif dalam sifat penelitian deskriptif dan bentuk penelitian evaluatif. Pendekatan yang digunakan adalah pendekatan perundang-undangan, pendekatan perbandingan dan pendekatan historis dengan sumber data sekunder berupa bahan hukum primer dan bahan hukum sekunder. Sumber data dikumpulkan dengan teknik riset kepustakaan. Hasil penelitian yang mendasarkan pada teori Critical Legal Studies (CLS), menunjukkan lahirnya OJK telah mengakhiri “pertempuran” politik antara Pemerintah dengan BI. Politik hukum OJK berawal ketika pemerintahan Presiden BJ Habibie mengajukan amandemen UU BI No 13 Tahun 1968 menjadi UU No 23 Tahun 1999 yaitu pada Pasal 34 yang mengamanatkan bahwa tugas mengawasi bank akan dilakukan oleh lembaga pengawasan sektor jasa keuangan yang independen. Hal itu dipicu karena adanya krisis keuangan tahun 1997/1998. Pembentukan OJK terdapat kecenderungan tarik menarik kepentingan politik yang menyebabkan lahirnya OJK tertunda hampir sepuluh tahun. Politik hukum seharusnya mengutamakan kepentingan dan kesejahteraan rakyat, karena politik hukum merupakan strategi atau langkah yang ditempuh untuk mencapai tujuan pemerintah atau negara. Akan tetapi, politik hukum pembentukan OJK belum mengutamakan kepentingan rakyat, karena masih ditunggangi kepentingan-kepentingan di luar hukum yang mengabaikan kepentingan rakyat. Keberadaan OJK di Indonesia terinspirasi pada negara Inggris dan Korea Selatan yang gagal menerapkan OJK serta negara Jepang yang berhasil menerapkan OJK. Berdasar perbandingan ketiga negara tersebut dapat dirumuskan kendala yang akan dihadapi OJK di Indonesia yaitu kendala independensi, kendala koordinasi, kendala integrasi pengorganisasian struktur pegawai, dan kendala harmonisasi peraturan. Pembentukan OJK harus dijadikan suatu momentum utuk membuktikan bahwa OJK benar-benar mampu menggantikan peran BI sebagai lembaga pengawas sektor perbankan dan dapat mewujudkan pengawasan perbankan yang lebih baik. Politik hukum jangan dijadikan suatu permainan politik. Politik hukum harus bertujuan untuk mementingkan kepentingan rakyat demi terwujudnya stabilitas ekonomi dan kesejahteraan rakyat. Politik hukum diharapkan lebih transparan, akuntabel dan disosialisasikan kepada masyarakat. Untuk itu ke depannya, pemerintah harus dapat mewujudkan politik hukum yang mengutamakan stabilitas ekonomi dan kesejahteraan rakyat sehingga tidak mudah merubah suatu sistem.
